These Terms of Use apply to FernPass, which is operated by Elavora Limited, trading as Memi Digital. By using FernPass, you agree to these terms. If you do not agree, please stop using the app.

Educational purpose

FernPass is a free, advertising-supported study aid for people learning the New Zealand road code across supported licence Classes 1, 2, 3–5, and 6. Its lessons, questions, explanations, and practice activities are provided for general educational purposes only. FernPass is not a substitute for official road-code material, official guidance, or professional driving instruction.

No official affiliation or guarantee

FernPass is an independent product. It is not affiliated with, authorised, endorsed, sponsored, or operated by the New Zealand Transport Agency Waka Kotahi (NZTA) or any driver-licensing authority. Use of FernPass does not guarantee that you will pass any theory or practical test, obtain a licence, or achieve a particular result.

User responsibility

Road rules, test requirements, and official guidance can change. You are responsible for checking current information through official New Zealand sources, including NZTA, before relying on any topic covered in FernPass. You remain responsible for your decisions, conduct, and compliance with the law when studying, taking a test, or using a road.

Advertising

FernPass is supported by advertising supplied by third-party advertising providers. Advertising may be selected and displayed according to your consent choices, device settings, applicable law, and the provider's own policies. The appearance of an advertisement does not mean that Elavora Limited endorses the advertiser, its claims, or its products and services.

Acceptable use

You must use FernPass lawfully and responsibly. You must not:

• interfere with, damage, disable, or disrupt the app or related systems;
• attempt to bypass security, consent, access, or advertising controls;
• extract, copy, redistribute, or commercially exploit app content except where the law permits;
• use FernPass to infringe another person's rights or for unlawful, deceptive, or harmful activity; or
• misrepresent FernPass as an official NZTA or government product.

Intellectual property

FernPass and its original text, design, software, branding, and other content are owned by or licensed to Elavora Limited and are protected by applicable intellectual property laws. You may use the app for personal study. No other right or licence is granted except where expressly stated or required by law. Third-party names and marks remain the property of their respective owners.

Availability and updates

We may maintain, correct, update, change, suspend, or discontinue all or part of FernPass when reasonably necessary. We do not promise uninterrupted or error-free availability. Device compatibility, network conditions, third-party services, and operating-system changes may affect how the app works.

Liability

Nothing in these terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, including any applicable rights under New Zealand consumer law. Subject to those rights and to the maximum extent permitted by law, Elavora Limited is not responsible for loss caused by reliance on outdated or unofficial information, a user's failure to verify current official requirements, misuse of the app, or events outside our reasonable control.

Governing law

These terms are governed by New Zealand law. You and Elavora Limited submit to the non-exclusive jurisdiction of the courts of New Zealand, subject to any rights or forum protections that applicable law does not allow the parties to exclude.

广告

可接受的使用方式

• 提取、复制、重新分发或进行商业利用，但法律允许的情形除外；
• 利用 FernPass 侵犯他人权利，或从事违法、欺骗性或有害活动；
• 将 FernPass 冒充为 NZTA 或政府官方产品。

知识产权

FernPass 及其中的原创文字、设计、软件、品牌和其他内容归 Elavora Limited 所有或经合法许可使用，并受适用的知识产权法律保护。您可以将本应用用于个人学习。 除本条款明确说明或法律规定外，本条款不授予其他权利或许可。第三方名称和商标仍归 各自权利人所有。

可用性及更新

在合理需要时，我们可以维护、修正、更新、变更、暂停或停止 FernPass 的全部或 部分功能。我们不承诺本应用始终不中断或完全无错误。设备兼容性、网络状况、第三方 服务及操作系统变化均可能影响应用运行。

责任

适用法律
